A Federal High Court sitting in Benin, dismissed a suit filed by the African Action Congress (AAC) seeking to nullify the September 19, 2020 governorship election in Edo State.
AAC filed the suit seeking the nullification of the election over the unlawful exclusion of their political party from the list of parties that contested the poll.
The party also urged the court to nullify the election over the alleged exclusion of the names of its candidates by the defendant, the Independent National Electoral Commission (INEC) before the state gubernatorial election.
Delivering the ruling, the court presided over by Justice Adefunmilola Demi-Ajayi, held that though it was within the rights of the plaintiffs to file their applications within 14 days of publication of names of governorship candidates by the defendants, it failed to do so.
It, therefore, dismissed the application for being filed out of time. The court also awarded the cost of N100,000 in favour of the defendants.
